Terms of Service

1. Agreement to Terms

Welcome to BotBrained.ai, operated by BotBrained.ai LLC ("we," "us," or "our"). By creating an account or purchasing a subscription on botbrained.ai (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

These Terms constitute a legally binding agreement between you and BotBrained.ai LLC. We may update these Terms from time to time. Continued use of the Platform after any changes constitutes acceptance of the revised Terms. We will notify active subscribers of material changes by email.

2. Eligibility — You Must Be 13 or Older

You must be at least 13 years old to create an account. BotBrained.ai is a community where members post publicly, interact with other members, and share their own work — it is not a parent-managed learning product. We ask for your date of birth at sign-up and store it so we can enforce this minimum. We do not knowingly collect information from anyone under 13, and we will close any account we learn belongs to someone under 13.

If you are between 13 and 18, you may hold your own account, but you must have permission from a parent or guardian, and the person paying must be legally able to enter a contract. If you are under 18, do not post information that identifies you personally — your full name, school, address, phone number, or anything else that could be used to find you offline.

The person who pays for a membership must be at least 18 years old and legally capable of entering a binding contract.

2a. Your Content

You own what you post. Posts, projects, comments, images, links and everything else you contribute (“Your Content”) remain yours. We claim no ownership of it.

By posting, you grant BotBrained.ai a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce and distribute Your Content for the purpose of operating and promoting the community — including showing it to other members, featuring it on the site, and referencing it in videos or social posts about the community. This licence exists only so we can run the service; it ends when you delete the content, except for copies already made by other members or retained in backups for a reasonable period.

You are responsible for Your Content. By posting it you confirm that you have the right to do so, that it does not infringe anyone else's rights, and that it does not contain confidential information, credentials, API keys, or personal data belonging to other people.

AI-generated work. Much of what is posted here is made with AI tools. You are responsible for complying with the terms of whichever tools you used, and for being honest about what was AI-generated when it matters — for example, if you sell the result.

We may remove any content, at any time, that breaches these Terms — and we may do so without notice where the content is unlawful or poses a risk to members.

2b. Copyright Complaints (DMCA)

If you believe content on BotBrained.ai infringes your copyright, email hello@botbrained.ai with: your contact details; identification of the copyrighted work; the URL of the material you say infringes it; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorised to act for them; and your physical or electronic signature.

We remove infringing material promptly on receipt of a valid notice, and we terminate the accounts of members who repeatedly infringe. If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@botbrained.ai if you suspect any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

You must provide accurate, complete, and current information when registering. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscription and Payment

BotBrained.ai is offered as a monthly membership at the price displayed at checkout (currently $9.99/month), beginning with a 7-day free trial. We collect your payment method at sign-up but do not charge it during the trial. All fees are in US dollars. By subscribing you authorize us to charge your payment method when the trial ends and on a recurring monthly basis thereafter, until you cancel.

Payments are processed securely by Stripe, Inc. We do not store your full payment card details on our servers. Stripe's terms and privacy policy govern the processing of your payment information.

We reserve the right to change subscription pricing at any time. We will provide at least 30 days' written notice by email before any price increase affects your subscription. Continued use of the Platform after the effective date of a price change constitutes your agreement to the new price.

All charges are non-refundable except as expressly stated in our Refund Policy, which is incorporated into these Terms by reference.

5. Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at hello@botbrained.ai. Cancellation takes effect at the end of the current billing period. You will retain access to all course content through the end of the paid period. We do not prorate partial months.

6. Acceptable Use

This is a community. Most of these rules exist so it stays one. You agree not to:

• Share your account credentials, or let anyone else use your membership.
• Harass, threaten, demean, or pile on to other members. Blunt feedback on someone's work is welcome; contempt for the person is not.
• Post sexual content, gore, hate speech, or anything targeting someone's race, religion, gender, sexuality, or disability.
• Post content that sexualises or endangers minors, or attempt to contact a minor privately. Members here may be as young as 13.
• Post other people's personal information, or your own beyond what you are comfortable being public.
• Post credentials, API keys, or tokens — yours or anyone else's.
• Spam, advertise, or recruit. Sharing your own project is the point; mass promotion is not.
• Upload anything unlawful, defamatory, or infringing someone else's rights.
• Impersonate any person or organisation, including BotBrained.ai staff.
• Republish or resell other members' work as your own, or scrape the community by automated means.
• Circumvent technical measures protecting the Platform, or share paid content outside it.
• Use the Platform in any way that violates applicable local, state, national, or international law.

Any member can report a post or comment. We review reports and may remove content, suspend, or permanently ban accounts that break these rules — without refund, and without notice where the conduct is serious. We do not owe an explanation for a removal, though we usually give one.

7. Intellectual Property

Our Content. All course videos, written materials, quizzes, curriculum designs, logos, and branding on the Platform are the exclusive intellectual property of BotBrained.ai LLC or our licensors. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and view the course content for personal, non-commercial educational purposes only. No other rights are granted.

Student Work. Any projects, applications, code, artwork, or other creative works that a learner builds while using this Platform belong to the learner and their family. We claim no ownership over student-created work. We are proud of what our students build and may request permission to showcase student projects as examples — but we will always ask first and you are never obligated to share.

Feedback. If you submit suggestions or feedback about the Platform, you grant us a perpetual, royalty-free license to use that feedback to improve our products and services.

8. Course Content and Third-Party Embeds

Course lessons include video content hosted as unlisted videos on YouTube. By watching these videos, you are subject to YouTube's Terms of Service and Google's Privacy Policy. We configure our YouTube embeds to use privacy-enhanced mode where available and do not enable advertising on embedded videos.

Course content is provided for educational purposes only. We do not guarantee that any project built using our curriculum will achieve a particular outcome, generate revenue, or be free from technical issues. Programming and AI development involve learning by iteration — results will vary.

9. Disclaimers

THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We make no guarantees regarding the accuracy, completeness, or currency of course content. The technology landscape — especially AI tools — changes rapidly. We aim to keep our curriculum current but cannot guarantee that every third-party tool or API featured in our courses will remain available or unchanged.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOTBRAINED.AI LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless BotBrained.ai LLC and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content submitted by you or any learner on your account.

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, upon notice to you at the email address on your account. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or non-payment.

Upon termination, your right to access the Platform ceases immediately. Sections 7, 9, 10, 11, 13, and 14 of these Terms survive termination.

13. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Platform shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict-of-law provisions.

Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts. Before filing any formal legal action, you agree to contact us at hello@botbrained.ai and give us 30 days to attempt to resolve the dispute informally.

14. General Provisions

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BotBrained.ai LLC with respect to the Platform and supersede all prior agreements or communications. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
